§1

Definitions

For the purposes of these Regulations, the terms used below mean:

  1. Regulations – this document specifying the rules for using the Online Store and the rules for concluding and performing distance selling contracts via the equalo.eu Online Store.
  2. Online Store / Store – online service available at equalo.eu , through which the Customer may, in particular , place Orders for Goods.
  3. Seller – EQUALO Przemysław Bukato with its registered office in Warsaw, ul. Świeradowska 47, 02-662 Warsaw, NIP 5221719241, entered into the Central Register and Information on Business Activity, providing sales services via the Online Store.
  4. Customer – a natural person (including a Consumer and an Entrepreneur with consumer rights), a legal person or an organizational unit without legal personality, to which the law grants legal capacity, placing an Order in the Store.
  5. Consumer – a customer who is a natural person who concludes a legal transaction with an entrepreneur that is not directly related to his or her business or professional activity.
  6. Entrepreneur with consumer rights – a natural person concluding a contract directly related to his/her business activity, when the content of this contract indicates that it is not of a professional nature for this person, resulting in particular from the subject of the activity performed, disclosed in the CEIDG.
  7. Goods – products presented in the Online Store, which may be the subject of a Sales Agreement.
  8. Sales Agreement – ​​a contract for the sale of Goods within the meaning of the Civil Code, concluded at a distance between the Seller and the Customer via the Store.
  9. Customer Account – an electronic service, an individual Customer panel in the Store, available after registration and logging in (login + password), enabling, among other things, placing Orders, viewing Order history, and managing data.
  10. Basket – a functionality of the Store in which the Goods selected by the Customer, their quantity and price are visible, enabling the placement of an Order.
  11. Order – a declaration of intent of the Customer submitted via the Store, specifying the type and quantity of Goods, method of payment, delivery and Customer data, aimed directly at concluding a Sales Agreement.
  12. Registration form – an interactive form in the Store enabling the creation of a Customer Account.
  13. Order Form – an interactive form in the Store enabling the placement of an Order, in particular by selecting the Goods, payment and delivery method and providing Customer data.
  14. Contact form – an interactive form in the Store enabling the Customer to contact the Seller, including matters related to complaints, withdrawal from the contract and return of Goods.
  15. Order fulfillment time – the number of business days in which the Seller will complete the Goods covered by the Order and deliver them to the carrier.
  16. Working days – days from Monday to Friday, excluding public holidays in Poland.
  17. Customer Service Office / BOK – contact with the Seller is possible at the e-mail address: equalo.intl@gmail.com and via the contact form on the website equalo.eu .
  18. Newsletter – a free electronic service consisting in periodically sending the Customer information about the Store’s offer, promotions and news to the e-mail address provided.
  19. Civil Code – Act of 23 April 1964 – Civil Code.
  20. Consumer Rights Act – Act of 30 May 2014 on consumer rights.
  21. Act on the provision of services by electronic means – Act of 18 July 2002 on the provision of services by electronic means.


§2

General provisions

  1. The equalo.eu Online Store is run by the Seller at the address indicated in §1 and constitutes a platform for the distance sale of Goods.
  2. These Regulations are the regulations referred to in Article 8 of the Act on the provision of services by electronic means.
  3. The regulations specify in particular:
    • rules for registration and use of the Customer Account,
    • rules for placing Orders and concluding Distance Selling Agreements,
    • rules for delivery of Goods and payment,
    • rules for withdrawal from the contract, return of goods and complaints,
    • rules for using electronic services, including the Newsletter.
  4. The condition for using the Store is to read and accept the Regulations before placing an Order.
  5. The goods offered in the Store are brand new (unless expressly stated otherwise), original and free from physical and legal defects.
  6. Information about the Goods (including descriptions and prices) published in the Store constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.


§3

Rules for using the Online Store

  1. The condition for using the Store (including viewing the offer and placing Orders) is:
    • having a device with Internet access,
    • up-to-date web browser,
    • active e-mail account.
  2. Registering a Customer Account is not mandatory – the Customer may place an Order as a guest, but the Account allows, among other things, viewing Order history and using additional features (e.g. discounts).
  3. The customer is obliged to:
    • use the Store in accordance with the law, good customs and the provisions of the Regulations,
    • not transmitting illegal content that infringes personal rights or the rights of third parties,
    • not taking any actions that may disrupt the operation of the Store (e.g. hacking attempts, mass sending of inquiries),
    • use the content of the Store solely for personal use.


§4

Registration and Customer Account

  1. The Customer Account service is provided electronically free of charge and for an indefinite period.
  2. An Account is created by completing the Registration Form and accepting the Regulations.
  3. Data marked as mandatory is required to create an Account. Providing other data is voluntary.
  4. After completing the Registration Form, the Customer will receive an e-mail confirming registration and activation of the Account.
  5. The Customer may resign from the Account (delete the Account) at any time by submitting a request to delete the Account to the Seller's e-mail address or by using the available functionalities.
  6. The Seller may block or delete the Customer Account with immediate effect if the Customer grossly violates the provisions of the law or the provisions of the Regulations, in particular when:
    • provides false data,
    • infringes personal rights or the rights of third parties,
    • commits abuses within the Store.
  7. Deleting the Account does not affect the validity of Sales Agreements concluded before deleting the Account.


§5

Placing Orders

  1. The Customer may place Orders:
    • via the Customer Account,
    • as a guest – without registration.
  2. Orders can be placed 7 days a week, 24 hours a day.
  3. Placing an Order requires completing the Order Form, selecting the Goods, method and date of delivery, payment and acceptance of the Regulations.
  4. Until the Order is confirmed (the “Buy and pay” button or equivalent), the Customer may modify the entered data and the contents of the Cart.
  5. Placing an Order by the Customer constitutes an offer to conclude a Sales Agreement addressed to the Seller.
  6. After receiving the Order, the Seller shall immediately send the Customer a confirmation of its receipt to the Customer's e-mail address.
  7. The Sales Agreement is concluded when the Seller sends the Customer an e-mail confirming acceptance of the Order for execution.


§6

Order Fulfillment

  1. Order processing begins:
    • after confirming receipt of the Order – in the case of payment on delivery,
    • after the payment has been recorded – in the case of payment in advance (traditional transfer, electronic payment, card).
  2. The Seller reserves the right to verify the Order by telephone or email in the event of reasonable doubts as to its authenticity.
  3. In the event of unavailability of the Goods, the Seller will contact the Customer in order to:
    • proposing an extension of the implementation deadline,
    • propose a replacement Product,
    • partial execution of the Order,
    • withdraw from the Agreement in whole or in part and return the payment.
  4. In the event of complete impossibility of fulfilling the Order, the Seller may withdraw from the Agreement within 3 days of its conclusion, refunding the Customer the full amount paid for the Goods.


§7

Delivery and shipping costs

  1. Delivery of Goods is carried out within the territory of the Republic of Poland and other countries, if the Seller makes them available.
  2. The goods are delivered to the address provided by the Customer in the Order via the selected courier company.
  3. Shipping is ALWAYS FREE.
  4. The Store's mechanism may allow the placement and payment of a single Order for Goods delivered in more than one shipment. Some items may be shipped from different warehouses or directly from external suppliers, necessitating delivery in several separate batches. Information on the number of shipments, the expected delivery date, and the delivery method for each shipment is presented to the Customer in the Order Summary before the order is placed.
  5. The Seller will use reasonable efforts to ensure delivery or deliveries are made within the stated deadline. Liability for delays resulting from causes attributable to the carrier or external supplier is limited in accordance with mandatory provisions of law.


§8

Prices and payments

  1. All prices of Goods given in the Store are gross prices (including VAT) and are expressed in Polish zloty.
  2. The prices of the Goods do not include delivery costs, which are charged separately.
  3. The prices applicable at the time of placing the Order are binding on the parties to the Sales Agreement.
  4. The customer can choose the following payment methods (adapt to those actually available):
    1. payment on delivery (only for some products)
    2. traditional transfer to the Seller's bank account,
    3. electronic payment / quick transfer / payment card, carried out via a payment operator (e.g. Przelewy24, PayU, PayPal, etc.).
  5. Details for traditional transfer:

  6. In the event of an obvious error in the price (grossly different from the market value), the Seller reserves the right to cancel the Order after informing the Customer and proposing the conclusion of a contract on correct terms.


§9

Order Change, Withdrawal and Return of Goods (General Information)

  1. The Customer may ask the Seller to change or cancel the Order until it is shipped by contacting the Seller via the Contact Form or by e-mail to Customer Service.
  2. The Consumer and the Entrepreneur with consumer rights have the right to withdraw from the Distance Selling Agreement within 14 days without giving any reason and without incurring any costs other than those provided for by law (detailed rules – in §11).
  3. The detailed returns and complaints procedure is available on the Store's website.


§10

Complaints (warranty and guarantee)

  1. The Seller is obliged to deliver the Goods in accordance with the contract, free from physical and legal defects.
  2. The customer may file a complaint in particular regarding:
    • non-conformity of the Goods with the contract,
    • physical or legal defects of the Goods.
  3. Complaints can be submitted:
    • in writing to the address of the Seller's registered office,
    • by e-mail to the Customer Service Office address,
    • via the Complaint/Contact Form available in the Store.
  4. The complaint should include: Customer details, Order number, description of the defect and request (e.g. repair, replacement, price reduction, withdrawal from the contract – in accordance with the regulations).
  5. The Seller will respond to the complaint within 14 calendar days of its receipt. Failure to respond within this timeframe will constitute acceptance of the complaint.
  6. The Customer, exercising their warranty rights, is obligated to deliver the Goods in question to the address provided by the Seller. In justified cases, the Seller will cover the delivery costs.
  7. Consumers and entrepreneurs with consumer rights may use out-of-court dispute resolution methods (e.g., through the Provincial Trade Inspectorate or the ODR platform). Information is available, among others, on the UOKiK website.


§11

Withdrawal from the contract by the Consumer and the Entrepreneur under consumer rights

  1. A consumer and an entrepreneur with consumer rights who have concluded a distance contract may withdraw from the contract within 14 days without giving any reason.
  2. The withdrawal period starts from:
    • taking possession of the Goods by the Customer or a third party other than the carrier,
    • taking possession of the last Goods or part if the contract covers multiple Goods delivered separately,
    • taking possession of the first Goods in the case of a contract for regular delivery of goods for a specified period of time.
  3. To meet the deadline, it is sufficient to send a declaration of withdrawal before its expiry (by traditional mail or e-mail to the Seller's address).
  4. In the event of effective withdrawal from the contract, the contract shall be deemed not to have been concluded.
  5. The Customer is obliged to return the Goods immediately, no later than 14 days from the date of submitting the declaration of withdrawal.
  6. The Seller will refund to the Customer all payments received from him, including the costs of delivering the Goods (except for additional costs resulting from the Customer's chosen delivery method other than the cheapest standard delivery method offered by the Store), immediately, no later than 14 days from the date of receipt of the declaration of withdrawal.
  7. The Seller may withhold reimbursement until the Goods are received back or the Customer provides proof of having sent them back, whichever comes first.
  8. The Customer bears the direct costs of returning the Goods (return shipping costs).
  9. The Customer is liable for any reduction in the value of the Goods resulting from their use in a manner that goes beyond what is necessary to establish the nature, characteristics and functioning of the Goods.
  10. The right of withdrawal does not apply in the cases specified in Article 38 of the Consumer Rights Act, in particular when the subject of the service is:
    • an item that spoils quickly or has a short shelf life,
    • an item in a sealed package that cannot be returned after opening for health or hygiene reasons if the package was opened after delivery,
    • an item that, due to its nature, is inseparably connected with other items after delivery,
    • the service was fully performed with the express consent of the Customer before the expiry of the withdrawal period.


§12

Refund

  1. Refunds to the Customer will be made in particular in the event of:
    • effective withdrawal from the contract,
    • a accepted complaint when it is not possible to repair or replace the Goods,
    • cancellation of an Order paid in advance,
    • withdrawal from the contract by the Seller due to permanent impossibility of performance.
  2. The refund will be made using the same payment method used by the Customer, unless the Customer expressly agrees to a different method.
  3. The Seller may ask the Customer to provide additional data necessary to properly process the refund, if necessary (e.g. bank account number).


§13

Final provisions

  1. In matters not regulated by the Regulations, the generally applicable provisions of Polish law shall apply, in particular the Civil Code, the Consumer Rights Act and the Act on the provision of electronic services.
  2. The Seller may change the Regulations for important reasons, in particular:
    • changes in legal regulations,
    • changes to the payment method, delivery method or functionality of the Store,
    • changes to the Seller's data.
  3. The Regulations in force on the date of placing the Order shall apply to Sales Agreements concluded before the date of entry into force of amendments to the Regulations.
  4. Disputes arising between the Seller and a Customer who is not a Consumer will be resolved by the court having jurisdiction over the Seller's registered office.
  5. The Regulations are available on the equalo.eu website in a form that allows them to be obtained, reproduced and saved.
  6. The customer may unsubscribe from the Newsletter service at any time.
